IndiGo, India's largest air carrier, has filed a legal suit against Mahindra Electric Automobile Limited, accusing the automaker of trademark infringement for using '6E' in its newly unveiled electric vehicle, the Mahindra BE 6E. The case is under review by the Delhi High Court, with the next hearing slated for December 9, 2024.
IndiGo's Case for Trademark Infringement
IndiGo operates under the call sign '6E', a crucial element of its brand identity. The airline uses the trademark extensively across its services, including:
6E Prime: Seat selection, priority check-in, and snacks.
6E Flex: Flexible rescheduling and cancellation options.
6E Add-Ons: Services like extra baggage and lounge access.
The airline registered the trademark "6E Link" in 2015 under multiple classes, securing its rights for use in advertising, airline services, and promotional materials. IndiGo asserts that Mahindra's use of '6E' infringes upon its brand identity and poses a risk of confusion, despite operating in distinct industries.
In an official statement, IndiGo emphasized:
"The '6E' mark is integral to IndiGo's identity and represents 18 years of goodwill. Any unauthorized use constitutes an infringement of our rights and reputation."
Mahindra's Stance on the Trademark Dispute
Mahindra Electric recently filed for trademark registration of "BE 6E" under Class 12, which pertains to motor vehicles. The company unveiled the BE 6E on November 26, 2024, as part of its electric SUV lineup.
In response to IndiGo’s claims, Mahindra stated:
"Mahindra's mark is 'BE 6e,' not the standalone '6E.' This differs fundamentally from IndiGo's use of '6E,' which represents an airline. The distinct styling eliminates any risk of confusion."
Mahindra also revealed it in discussions with IndiGo to seek an amicable resolution.
The Legal Battle Ahead
The dispute underscores the growing importance of trademarks in brand identity across diverse industries. While IndiGo's trademark focuses on aviation services, Mahindra argues its electric vehicle branding is distinct.
