There are several simple ways to purchase a car or vehicle of your choice these days. One can acquire a vehicle with state-of-the-art features or peak engine output if one can afford it. However, the sad part is that not everyone has that sort of money to enjoy such luxuries.

That is where banks come in handy. Most people take a bank loan to purchase their dream vehicle. When the banks handle the credit, one gets the car in no time. However, the hypothecation with the bank on the paperwork will stay until the loan is completed.

Nowadays, it is much easier to purchase a dream vehicle with a loan with convenient EMI alternatives, faster processing, and low-interest rates. In addition, the number of banks prepared to invest in high-risk clients has increased manifold.

Unless customers pay off the automobile loan, the lender has legal ownership of the asset. In other words, the asset is still hypothecated with the bank, and the details must be documented in the Registration Certificate.

As a result, as soon as the loan is paid off, one must remove the hypothecation from the Registration Certificate to transfer ownership to a personal name. After completing the process, a new RC is issued in the new owner's name.

What is the definition of hypothecation?

Hypothecation is the procedure of using an automobile as collateral to secure a loan from a third party while maintaining ownership, title, and rights to the vehicle. Simply put, one offers a vehicle to the lender as security until the owner has paid off the entire loan amount.

Documents Needed to Remove Hypothecation

After the automobile loan is paid off, the bank will issue the necessary papers with removing the hypothecation from the vehicle. The following documents need to be submitted to RTO:

  • NOC: The NOC will validate the execution of the hypothecation agreement between the bank and the loan account holder. This is the foundation document requested by the RTO to remove the remark from the Registration Certificate.
  • Form No. 35: This is a request to the RTO to revoke the hypothecation. This paper also confirms that the loan with the bank has been paid off.
  • Valid Insurance Policy: One must provide a valid car insurance policy to complete the process of terminating the hypothecation on the vehicle.
  • PUCC: To remove the hypothecation on the vehicle, the RTO also demands the Pollution under Control Certificate of the vehicle.

When the automobile loan is completed, the lender will supply relevant documents to demonstrate their written permission for hypothecation termination. The NOC is the document and is only valid for three months after it is issued. Before the NOC expires, an application should be filed to the Regional Transport Office.

How to Get Rid of Hypothecation in RC Online?

If one wants to apply for RTO Hypothecation Removal Process online, one can utilize the Parivahan website to make the payment. The following steps can help remove hypothecation from RC online:

  • Go to the Parivahan Seva website of the government.
  • Go to the Online Services section and check the options.
  • Select Vehicle-Related Services from the drop-down menu and enter the state and RTO office details.
  • After entering the Registration and Chassis numbers, one gets to the gateway for submitting an online application for the hypothecation cancellation form.
  • After that, one must go to the appropriate RTO and submit the application and supporting documentation to remove the hypothecation on the car registration certificate.

When a car is bought on loan, and the customer wishes to transfer ownership to his name after paying off the debt, he needs to fill out RTO Form 35. This document must be filed to the RTO to inform that the person's agreement with the bank or other financial institution has ended. When removing a vehicle's hypothecation, all details have to be filled in RTO Form 35.

This form has an opening and concluding section, and both need to be filled out. The Registered Owner and the Financier must be mentioned in the introduction section, and the hypothecation must be terminated with an official statement in the concluding section.

Vehicle registration details and RTO names have to be mentioned in the form. The applicant's signature and the automobile number indicated in the old RC are required. Apart from that, the official bank seal, and the date of agreement cancellation, must be included in the form. The RTO's responsible person then signs the application form.

How can I see if hypothecation has been removed from my account?

The Parivahan portal can be used to verify the status of hypothecation cancellation for the vehicle's RC. To check the status of the application, one must enter the application number.

Is it necessary to remove my vehicle's RC hypothecation?

Yes, if the agreement with the bank is dissolved, one must erase the RC hypothecation for the vehicle. If not done, the insurance money will be directed to the appropriate bank rather than the actual owner.

What is the best way to see if a car is still financed?

The simplest way to see if your car is financed is to look at the RC of the vehicle. The RC explicitly states the organization's name to whom the vehicle is hypothecated; thus, one can see if the car has a debt against it.

How long does hypothecation take to remove?

The bank will usually issue the No Objection Certificate in two to three weeks. After receiving it, take the previous vehicle registration and smart card to the RTO to remove the hypothecation.
